Copyright and Takedowns

How to report a game that infringes your rights, and how to answer a report filed against yours.

1. The short version

If something on NUGANUGA infringes your copyright, tell us at legal@nuganuga.com and we will act on it. If your game is taken down and you believe that was wrong, tell us and we will look again.

We take repeated infringement seriously: an account that keeps publishing infringing games loses the ability to publish.

2. Filing a notice

Send the following to legal@nuganuga.com, with "Copyright" in the subject. A notice missing any of it cannot be acted on, and we will tell you which part is missing rather than ignoring it:

  • the work you say is infringed, identified well enough for us to find it
  • the URL of the game or content on https://nuganuga.com that infringes it
  • your name and an address we can reply to
  • a statement that you believe in good faith that the use is not authorised by the rights holder, its agent, or the law
  • a statement that the information in the notice is accurate, and that you are the rights holder or authorised to act for them
  • your signature, electronic or physical

3. What we do with it

We acknowledge the notice, and if it is complete we disable access to the content, usually within three business days. We tell the creator what was removed and who filed the notice, and we keep a record of both.

A notice that is obviously abusive — filed against a competitor, or against content the filer plainly has no rights in — is refused, and repeated abuse loses the ability to file.

4. Answering a notice

If your game was disabled and you believe the notice was mistaken or the use is permitted, send a counter-notice to legal@nuganuga.com with:

  • the content that was removed and where it was
  • a statement, under penalty of perjury where that applies to you, that you believe it was removed by mistake or misidentification
  • your name, address and a means of contact
  • your consent to the jurisdiction of the courts of 대한민국 (Republic of Korea)
  • your signature

5. After a counter-notice

We forward the counter-notice to whoever filed the original. If they do not tell us within 10 to 14 business days that they have begun a court action, we restore the content.

6. Trademarks and other complaints

Trademark complaints, impersonation of a creator or brand, and complaints about content that is not a copyright matter also go to legal@nuganuga.com. They are handled through the same moderation queue, and you will get an answer either way.
